House Rules

Dear Guest,

Thank you for choosing to book with WINK Foreshore Aparthotel. When you make this booking, you are agreeing to abide by the Terms and Conditions as set out with us (Wink Aparthotels (Pty) Ltd – hereafter referred to as WINK Foreshore Aparthotel or WINK Foreshore). WINK Foreshore Aparthotel is a short-term, furnished, and serviced apartment development, allowing resident’s/tenant’s all the comforts, flexibility and convenience of a self-catering hotel with the space and amenities of conventional apartment living.

We look forward to welcoming you to WINK Foreshore. We strive to provide our guests with an exceptionally clean, safe, and friendly aparthotel experience. The following terms and conditions have been established based on industry standards, management and operational procedures, and our personal experience of owning and operating the WINK Aparthotels Group.

RATES & BOOKINGS

WINK Foreshore reserves the right to change the quoted rates without notice, however, rates quoted for confirmed bookings will be honoured. A verbal or email booking without prepayment and presentation of necessary documentation is not seen as a confirmed booking. Should bookings be referred to WINK Foreshore from an agent, this will need to be presented in the form of a voucher and signed confirmation, in addition, you will be required to sign this T&C acceptance prior to checking into the apartment to complete your booking with WINK Foreshore.

PAYMENT

Failure to meet the payment deadlines as set out in the Terms and Conditions will result in WINK Foreshore reserving the right to terminate and or cancel your reservation and issue a Late Payment Breach notice. Upon issue thereof WINK Foreshore reserves the right to have the guest vacate the apartment within 24 hours of notice being issued, should you not comply to rectify the breach. If you do not rectify the breach, your reservation will be cancelled, and you will be an illegal occupant of the apartment. WINK Foreshore may then proceed to initiate an eviction process in terms of the Prevention of Illegal Eviction Act. You will furthermore be blacklisted with South African Credit Bureau’s.

WINK Foreshore Aparthotel accepts the following forms of payment of the deposit and rental: EFT, Credit and Debit cards. Credit cards may incur a 2.5% surcharge. Any bank charges incurred by WINK Foreshore in relation to international funds transfers are to be paid by you and will be added to the balance due on your departure. Certain special promotions and rates carry their own terms and conditions which apply accordingly.

REFUNDABLE BREAKAGE DEPOSIT

WINK Foreshore Aparthotel reserves the right to take a breakage deposit upon check-in. The deposit will be processed upon arrival using the guests’ debit or credit card. No cash payment is accepted at the Front Desk.
The amount for deposits is calculated as follows:

1 – 13 night stay will incur R500 once off deposit
14 – 21 night stay will incur R1000 once off deposit
21 – 30 night stay will incur R2000 once off deposit

Month to month stays or longer will need to be approved by management with supporting documentation and deposit equivalent to a month and a half’s stay as well as a signed occupancy agreement.

The refundable deposit will be reimbursed to the guests’ card that the payment was taken from upon the accepted outgoing inspection is conducted. You, as the resident/tenant shall ensure that the apartment shall be clean and all repairs and replacement items attended to at time of inspection. WINK Foreshore will, if replacement or repairs are required, utilise the deposit.

WINK Foreshore shall be entitled to apply the deposit at any time to settle your indebtedness under this T&C Policy. Such indebtedness may include, but will not be limited to, arrear rental or damages caused to the apartment.

Residents/tenants are responsible and liable for any breakages or damage that is caused whilst occupying the apartment, including any accidents that may occur. If any damage is caused, residents/tenants are responsible up to the full cost of replacement or repair. The costs will be invoiced after departure and must be settled via EFT. This also applies to anything that goes missing from the apartment during occupation. One key, tag and remote lost, will incur a R500 charge for replacement.

An ingoing and outgoing inspection will be conducted, and it duly noted that should any damage be caused to the contents and structural features of the apartment this will be deducted from the deposit.

CANCELLATION & DEPOSIT

WINK Foreshore reserves the right to cancel the reservation at any time, should you breach any of the provisions as set out in this Terms and Conditions document, house rules or conduct rules of WINK Foreshore Sectional Title Scheme. Cancellation shall be affected in terms of the provisions of the Consumer Protection Act by giving you 20 business days’ notice to rectify your breach, alternatively in terms of the Rental Housing Act, or both, as the case may be. Failure to rectify your breach will result in cancellation of this reservation and you thereupon becoming an illegal occupant in terms of the Prevention of Illegal Eviction Act.

RESERVATIONS

Should a reservation remain unconfirmed, which means that the required amount is not paid. Confirmation of a reservation is completed on receipt of proof of payment per email, within 24 hours of the presentation of a quotation by WINK Foreshore. WINK Foreshore reserves the right to release the reservation should another reservation arise. A quotation presented by WINK Foreshore to an interested party is not a confirmed reservation. All WINK Foreshore’s banking details appear on quotations, pro-forma invoices and invoices.

NON-AVAILABILITY

WINK Foreshore Aparthotel would only cancel a booking if the accommodation was unavailable for reasons beyond the control of WINK Foreshore. WINK Foreshore will attempt to offer the resident/tenant alternative accommodation, however if this was not possible, or unacceptable to the resident/tenant, then WINK Foreshore shall refund all monies paid. WINK Foreshore’s Liability shall not extend beyond this refunded amount.

PARKING

WINK Foreshore has secure paid parking available on request. This parking is directly behind the hotel entrance in Tulbagh Square. Should you wish to secure a parking bay for your stay, please make prior arrangements with our reservations team or duty manager directly. This can be settled upon arrival and a parking disc will be sent to you via Whatsapp or Email to ensure that you are granted access upon arrival. Alternatively, there is off street parking along Heerengracht Street.

SECURITY

WINK Foreshore requires all visitors and guests to fill in the visitor book. We have access control entrance and have security on site from 18:00 – 06:00.

Should guests require assistance with luggage upon arrival and would like to be accompanied by security or Duty Manager, do not hesitate to contact us via Whastapp to accompany guests. Guests are particularly requested to lock the door of their rooms when going out and or going to bed. For the convenience of the Guest, electronic safety lockers are provided in the room to store any valuables.

CHECK IN

WINK Foreshore allows for check-in from 14:00 to 18:00. Should guests require a later check-in time from 18:00 – 21:00 please ensure that this is communicated to our reservations team or duty manager with prior notice as we do not offer a 24hour check in desk. We recommend all our guests complete the online guest registration and COVID declaration prior to arrival to facilitate a fast and limited contact process.

We require for all guests to present a valid ID and or Passport on arrival and confirmation of reservation and payment.

WINK Foreshore does not accept: CASH, CASH DEPOSITS or CHEQUES.
WINK Foreshore can process card payments and SnapScan for extras, but require full prepayment either via Electronic Transfer or Virtual Credit Card.
Guests are always required to have their temperature checked upon arrival and need to be wearing a face mask. Guests must sanitize hands upon arrival.

HOUSEKEEPING

Due to WINK Aparthotel being an apartment like stay, we do not offer daily housekeeping. We are also very serious about limiting guest and staff interactions to prevent contractions of COVID 19.

We provide a room refresh every third day with a linen change for short term stays and a weekly room refresh for monthly stays. Should guests require fresh linen and towels, do not hesitate to contact our Duty Manager for assistance.
Should guests require an iron and ironing board, this will also be available on request and you may contact the Duty Manager to bring this to your studio.

FACILITIES & AMENTIES

WINK Aparthotel prides itself in its home comfort facilities. Each apartment is fitted with kitchen accessories and equipment. Please treat these items with care and ensure to report any missing or damaged items to front desk.
Each apartment has a SMART Television with NETFLIX, SHOWMAX & YOUTUBE functionality. Guests are required to log onto these platforms using their own login credentials. The Aparthotel does not provide access to logins or DSTV.

Each resident/tenant will have access to uncapped wireless internet in their rooms. This will be provided by the appointed ISP in the form of a username and password. Resident/tenant s are to ensure that laptops/devices have wireless connectivity. As the service is managed by a third party, WINK Foreshore cannot guarantee internet access quality which is an exclusively wireless service.

INROOM GUEST BEHAVIOUR

  • WINK Aparthotel’s studios can accommodate a maximum of 2 guests per stay. Guests are not allowed to have any additional visitors to their apartments. Should guests wish to have a visitor, they would need to be signed in at reception and fill in the guest book with valid ID. Visits or business meetings can be held in common areas of the hotel like bar, restaurant, hall and not in the room. Should guests exceed the maximum number of guests allowed per apartment, you will be asked to rent another guestroom for proper accommodations or vacate the premises.
  • WINK Aparthotels Studios and Superior Studios does not accommodate any parties, celebrations, or gatherings.
  • Guests are encouraged to keep noise levels at a low out of respect for all other guests. Should guests be caught making a noise or playing loud music, they will incur a fine of R1000.
  • WINK Aparthotel is strictly a non-smoking establishment. We do not allow any smoking in the rooms or on the balconies. For safety and to assure that our facility is not exposed to items or actions that create an odour which is unhealthy and objectionable to our guests and staff, and that is difficult to remove from the air, carpet, walls, and furniture we do not permit smoking tobacco, marijuana, illegal drugs, e-cigarettes, vape pens, vaping, cartridges containing the liquid of nicotine, hookahs, incense, cooking, cigars, candle burning, the use or diffusing of patchouli oil or other strong-smelling plant-based essential oils or synthetic products in our facility.
    Guests are encouraged to notify Front Desk staff immediately if they smell cigarette, marijuana, or other objectionable odours.
    This policy is not intended to stop people from smoking, but to regulate where they smoke and how it affects others. A Designated Smoking Area is provided outside and away from the building.
    There are smoke detectors in all the rooms and should a guest be caught smoking, this will incur a fine of R3000.
  • Guest will be held responsible for any loss or damage to the property caused by themselves, their guests, or any person for whom they are responsible.
  • Guests are requested to please refrain from wiping makeup and or staining the towels and linen deliberately. Guests need ensure that they remove all their makeup prior to using the towels.
  • Each Apartment is fitted with a kitchenette and tea and coffee facilities, the amenities in the kitchen are to be used with care. Should guests wish to cook using the stove top, please ensure that a window is kept open to avoid the smoke alarm from going off. WINK Foreshore provides sufficient tea and coffee for 2 guests per stay. This is refreshed every third day.
  • Wink Aparthotels takes no responsibility for any parcels that are delivered. If no prior notice by writing is given the parcels will not be received by any employees of Wink Aparthotels.
  • No day guests will be allowed at WINK Foreshore without signing in and temperature taken if they are perceived as a risk due to a high temperature or showing signs of COVID. WINK Foreshore reserves the right to not allow the guests access. If guests are let into WINK Foreshore without signing in and the above done the guest will be asked to leave the premises immediately and the guest that has booked in with Wink Aparthotels will receive a warning, if it happens again a fine maybe imposed.

CHILDREN

Regretfully WINK Foreshore does not have suitable facilities to accommodate children or babies without prior notice being provided. This needs to be arranged and agreed upon with management.

HEALTH AND SAFETY

  • Each Studio is fitted with a fire extinguisher in the kitchenette. Guests are to be careful when cooking on the stove and always ensure that the correct equipment is used on the stove top and microwave.
  • Fire Escape Notices are on each Studio door, guests are to familiarize themselves with the fire escape routes and protocol.
  • COVID-19 Protocols are to be followed and adhered to by residents and guests at all times.

CHECK OUT

WINK Foreshore check-out time is 11:00. Should guests stay in the room after 12:00 this will be charged as an additional day.

We require for all guests to leave their room key and settle any extras incurred during their stay at reception before departing.

PETS

Building management and body corporate representatives will need to evaluate the residency of pets on a case-by-case basis after reviewing the situation according to strict criteria, taking into account the welfare of the tenants and of the animal itself.

MANAGEMENTS RIGHTS

It is agreed that the guest will conduct him/ herself in a respectable manner and will not cause any nuisance or annoyance within the Aparthotel premise.
The Management has the right to request any guest to vacate his/her apartment or other areas of the hotel forthwith, Without previous notice and without assigning any reason whatsoever, and the guest shall be bound to vacate when requested to do so. In case of the default, the Management has the right to remove the Guest luggage and belongings from the room occupied by him/her.

RISK OF LOSS OR DAMAGE & INSURANCE

Although WINK Foreshore will make every effort to ensure the safety of your property, this is not guaranteed and the ultimate responsibility rests with you to have your property comprehensively insured while in the apartment. Your obligation to have your property insured extends to your vehicle and its contents while on the WINK Foreshore premises.

LIABILITY

WINK Foreshore Aparthotel shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by the resident/tenant or any third party as a result of or which may be attributable, directly and indirectly to WINK Foreshore. The resident/tenant agrees on behalf of her/himself and the members of her/his party that it is a condition of his/their occupation of the apartment that neither WINK Foreshore Aparthotel, it’s owner, employees nor agents shall be responsible for any injury or death of any person. Said persons will not be held liable for the loss or destruction of, or damage to any property upon the premises, whether arising from fire, theft or any cause and by whomsoever caused or arising from the negligence (gross or otherwise) or wrongful act of any person in the employment of WINK Foreshore Aparthotel.

INDEMNITY: WINK FORESHORE APARTHOTEEL & RELATED ENTITIES

The resident/tenant shall not institute any claim against WINK Foreshore or any of its related entities for whatever cause or reason unless it is because WINK Foreshore was grossly negligent. This includes claims for any damages suffered as a result of any failure or interruption of any supplies or services to the apartment or WINK Foreshore Sectional Scheme. WINK Foreshore undertakes to perform no act or omission to prejudice the continuation or resumption of such supplies or services.

BREACH OF OCCUPANCY, BLACKLISTING & NOTICES

Any breach of any term or provision of this Terms and Conditions agreement shall be deemed a material breach in terms of the provisions of the Consumer Protection Act and will result in the cancellation of this reservation if not rectified within 20 (Twenty) business days’ following a notice sent to the resident/tenant telling him to rectify the breach.

Any claims for arrears rent may be instituted in tandem with the notice sent in terms of the Consumer Protection Act, however, such claim shall be aimed at rectification of the arrears breach within 5 days, failing which WINK Foreshore shall blacklist the resident/tenant forthwith at all South African credit bureau’s. The resident/tenant hereby acknowledges and agrees to be, in the event WINK Foreshore requiring the services of an attorney to enforce any of the terms of this Occupancy Agreement, liable for all legal costs on an attorney-client basis.

Any written notice by WINK Foreshore to the resident/tenant for purposes of any provision of this Terms and Conditions Agreement shall be competent and deemed to be sent to the resident/tenant’s domicilium address if sent to the email address provided by the resident/tenant on this Guest Registration. Delivery by hand shall have equal validity.
